Terms of Service

1. Formation of the contract

Reservations can be made in writing, by telephone, by e-mail or on the homepage (www.berlin-potsdam-camping.de) are made. With the registration, the camping guest offers the campsite the conclusion of a camping contract. The camping contract is only concluded with the written booking confirmation from the campsite and the transfer of the down payment in accordance with Section 3. There is no entitlement to a specific parking space and/or parking space number because the site is categorized and not subdivided.

 

2. Fee

The prices to be paid by the camping guest are based on the annually updated price lists of the campsite. The guest must find out about the prices for the services offered during the registration period.

The campsite points out its obligation to collect the visitor's tax from the camping guest in accordance with the applicable visitor's tax regulations for Schwielowsee. The tourist tax is due immediately on the day of arrival for the entire period of your stay.

 

3. Terms of Payment

A deposit is due upon receipt of the offer. This results from the length of the guest's stay and is communicated by e-mail. It is payable within 7 days of receipt of the offer on our account at Berliner Volksbank IBAN: DE07 1009 0000 2203 6850 01 / BIC: BEVODEBBXXX (BLZ 100 900 00 / account no. 220 36 85001), stating the booking number .

If the payment deadline expires without notice, the reservation will be deleted without separate notification and no effective contract will be formed.

An effective contract is only concluded upon receipt of the reservation confirmation.

The remaining balance is to be paid on site in cash or by EC card.

 

4. Arrival and departure times

The pitch is available to the camping guest on the day of arrival from 3:00 p.m. Registration is possible from 11:00 a.m. If you arrive after 6:00 p.m., please notify us at info@berlin-potsdam-camping.de. The pitch must be left clean by 11:00 a.m. on the day of departure. If the deadline is exceeded, an additional fee may be charged. However, clearing the premises in accordance with the contract is the main obligation of the camping guest.

The possibility of a later departure must be inquired about at reception and varies depending on the conditions on the site.

 

 

5. Stay / Visit

The campsite may only be used with the registered number of people. Visitors must be registered before entering the site. The regular pitch may only be occupied with camping equipment (1 tent or 1 caravan or 1 mobile home). Additional camping equipment and vehicles require the approval of the reception and must be registered for a fee.

The occupancy of double pitches with more than two pieces of camping equipment (2 tents or 2 caravans or 2 mobile homes) must be agreed in advance. It is not permitted to park a tow vehicle/transport vehicle in a double parking space, unless it is a self-contained mobile home.

 

The camping guest recognizes the site regulations for himself and for the persons he has registered. This is part of the contract. It is displayed in reception, published on the Internet and can be sent on request.

6. Defects

If the assigned pitch or other contractual services do not correspond to the contractually agreed characteristics, the camping guest must report the defects to the camping management on the day of determination, but no later than on the following day.

 

7. Video Surveillance

The Himmelreich campsite is under video surveillance.  The cameras used are intended to avert the following dangers from guests, the campsite and employees:

-    Documentation of accidents

-    Documentation of theft, burglary, assault

-     Campsite entrance and exit control to prevent unauthorized access to the campsite premises.

The data is recorded and temporarily stored. The video recordings are expressly not used for recording working hours. This processing of your above-mentioned data is justified to protect the legitimate interests of the campsite (Himmelreich Betriebsgesellschaft mbH). Without the use of this data, the campsite cannot guarantee security.

 

8. Liability

The guest and the persons accompanying him undertake to treat the pitch as well as the buildings, facilities, inventory, etc. of the campsite with care. Damage caused during the stay by the guest himself or his companions must be reported to the landlord immediately and replaced, with the exception of proof of no-fault. Claims by the camping guest for damages are excluded. Excluded from this are damages resulting from injury to life, limb or health if the campsite is responsible for the breach of duty, other damages which are based on an intentional or grossly negligent breach of duty by the campsite and damages which are based on an intentional or negligent breach of typical contractual obligations of the campsite. A breach of duty by the campsite is equivalent to that of a legal representative or vicarious agent.

However, the campsite expressly points out that irregularities, damage or losses (e.g. tree fruits, insects, animals, branches, etc.) caused by nature can occur.

9. Rebooking, cancellation, late or non-arrival and early departure

Rebookings of effective contracts are generally possible without a legally binding claim on the part of the guest. They become effective upon written confirmation from the campsite. Up to 28 days before arrival, the fee for rebooking in the case of firm bookings (changes in travel dates, reductions in the number of people or parking spaces, as well as changing parking spaces to another category) is an additional €5.00. From the 27th day before arrival, costs of €10.00 will be incurred.

The camping guest can withdraw from the contract at any time before the start of the trip. The declaration of withdrawal must be made in writing. If the camping guest withdraws from the contract, the campsite can demand the following flat-rate cancellation fees, which take into account the usual other use of the service and saved expenses:

-    Withdrawal up to 90 days before arrival: no cancellation fees

-    Cancellation up to 28 days before arrival: 25% cancellation fee

-    Cancellation 27-15 days before arrival: 50% cancellation fee

-    Cancellation 14-1 day(s) before arrival: 75% cancellation fee

-    Cancellation on the day of arrival or no-show without notice of cancellation: 100% cancellation fees

In the event of a late arrival (e.g. after the reception is open or on the following day), written notification must be sent to info@berlin-potsdam-camping.de required. Otherwise, the parking space will be given to someone else from 3:00 p.m. the following day.

In the event of shortening or early departure, the contractual fee for a period of up to 2 nights must be paid in full and 50% for each additional day from the day of the declaration.

Both in these cases and in the event of a notice of termination before the start of the trip, the camping guest is free to prove that the aforementioned claims have not arisen or have not arisen in the required amount. In any case, we recommend taking out travel cancellation insurance.

All prices and cancellation policies are subject to change without prior notice.

If the camping guest does not use the pitch without consulting the campsite, the camping guest has the option of trying to rent the pitch elsewhere. There is no obligation to do so. Any claims for payment by the landlord remain unaffected, taking into account the above agreements. However, the camping guest waives the rights to which he is entitled vis-à-vis the campsite if he does not notify the landlord and assert them at least in writing or by telephone by 11:00 a.m. on the day after arrival.

 

9.1 | Bookings during an epidemic

Anyone who books during a pandemic (SARS-CoV-2 since March 11, 2020 until unknown) must refer to point 8 of the General Terms and Conditions. If the federal government prohibits or advises against trips such as overnight stays and you book on your own responsibility, any overnight stay and travel bans that the federal government or the state of Brandenburg has issued apply. In this case, there is only the possibility of a free rebooking to an alternative date in the future. Please note that you should first wait for the decisions of the federal government.

 

10. Reservation and cancellation of events (brunches, buffets, etc.)

1. Event reservations are binding. The cancellation of the reservation for the event is free of charge up to 72 hours before the reserved time.

2. If the cancellation is not carried out by the time specified in Section 1, we reserve the right to charge compensation for the unused service in the amount of the event costs.

3. The customer is free to prove that the claim for payment did not arise or did not arise in the required amount.

4. The organizer's right to demand further damages in accordance with the statutory provisions remains unaffected by this.

 

11. Other Agreements

As far as the term campsite is used in the general terms and conditions, this means the company Himmelreich Betriebsgesellschaft mbH, managing directors Roger and Maximilian Groß.

Telephone information, side agreements and other assurances of any kind require written confirmation to be effective. Otherwise, the statutory provisions apply.

 


12. General Terms and Conditions/Notes Ticket sales for the Oktoberfest

These General Terms and Conditions apply to all contracts between the organizer Himmelreich Betriebsgesellschaft mbH – hereinafter referred to as the organizer – and the ticket purchaser.

 

With the purchase of an entry ticket, the purchaser and entry ticket holder accept the following contractual conditions of the organiser.

Young people under the age of 16 only have access to the event with a person who has parental or legal guardianship within the meaning of Section 1 (1) No. 4 JuSchG.

Young people aged 16 and over have access until midnight without a written declaration of consent. The ID must be presented at the entrance control. The serving of alcoholic beverages to young people is controlled. – The Youth Protection Act applies in all cases!

Bringing glass containers, bottles, pyrotechnic objects, torches and weapons (pocket knives, scissors, pepper sprays, etc.) is generally prohibited. Failure to comply will result in removal from the event site. A security check will take place at the entrance to the event site. The organizer reserves the right to use the entrance for important reasons (against reimbursement of the face value of the entrance ticket).

Sound devices and professional photo, film, video and digital cameras are generally not permitted. Sound, film, digital and video recordings, including for private use, are strictly prohibited. Abuse will be prosecuted. Simple digital cameras without interchangeable lenses are permitted (no professional equipment, no film cameras).

The organizer reserves the right to expel visitors from the event site who are in closed-off areas without presenting appropriate legitimation. In this case, there is no right to a refund of the entrance fee. The organizer reserves the right to expel visitors who damage or steal the organizer's property from the event site and to report this. In this case, there is no right to a refund of the entrance fee.

The ticket loses its validity when you leave the event site. Re-entry can only be granted with a valid entry bracelet.

If the event is interrupted or canceled due to reasons for which the organizer is not responsible (force majeure/storms, public unrest, fire, etc.), there is no right to a refund of the ticket price.

Reimbursement of travel expenses is generally not possible. The visitor is asked to find out before departure whether the event will take place as planned.

The organizer reserves the right to change the location and/or date of the event.

The organizer has no influence on the design, length and content of the individual performances. The organizer reserves the right to make changes to the timing of the event. In the event of the cancellation of individual artists, the organizer will endeavor to find a suitable replacement.

Commercial resale of tickets is not permitted.

The distribution of flyers, promotional CDs, free samples, etc. without written permission is prohibited anywhere on the event site. The sale and offering for sale of goods (including food and luxury goods) of any kind are strictly prohibited on the entire site.

By entering the event site, the visitor waives the right to their own picture. The organizer is entitled to produce image, sound and image sound recordings of the visitors within the framework of the events without remuneration and to use them or have them used comprehensively in all known and future media, in particular but not exclusively for reporting and advertising the Oktoberfest in the Himmelreich Caputh and all other events.

Basically, there is a risk of possible damage to health, especially hearing damage from loud music. The visitor is responsible for the appropriate hearing protection. The organizer assumes no liability for this.

The organizer is not liable for items lost or stolen during the event. The instructions of the event staff and security must be followed.

The legal form of the Federal Republic of Germany applies exclusively. Sole place of performance for delivery, performance and payment is Caputh. Should individual points from these conditions be or become invalid, the validity of the rest of the contract shall not be affected.
